Summary:This report develops the theme of interim instruments, and particularly its inclusion in the Portuguese resolution regime, with the purpose of increasing operational feasibility and legal security in the application of the bail-in measure. This theme arises from the international developments, where new strategies and instruments are being formulated with view to a more effective operationalisation of this resolution measure. The report is divided in two parts: in Part I, the theme of resolution is presented, and, in particular, the bail-in measure, establishing common ground with an explanation of the concepts concerned in a descriptive approach; in Part II, there is a problematization of the current regime, and several analysis are conducted in order to formulate solutions related to the characterization of interim instruments and its introduction in the current legal order. Taking stock of the considerations drawn from this study, it is concluded that the introduction of interim instruments can make a positive contribution to the objective of increasing the operational effectiveness of the bail-in resolution measure.
