Resumo:Participatory democracy has emerged in order to correct any disconnections between the acts of government and population’s interests in the representative democracy, through the provision of tools for popular political participation. In this context, we glimpse the popular initiative, which allows citizens the exercise of legislative activity. In Brazil, this tool is provided in art. 14, III, and art. 61, § 2, both of the Federal Constitution. However, the way that the mechanism was fixed was really fragile if compared to other countries, as well as the requirements complicate its implementation in a way that it has not become something usual in Brazil yet. Law 9.709/1998 also did not instrumentalize the popular initiative, losing the opportunity to uncomplicate its implementation. Despite the difficulties, the popular initiative is an important and effective tool for the population to defend its interests, because it allows citizens to start the process of developing laws that will protect their own interests, as has already occurred in brazilian democracy.
