Thus, an analysis is made of the main aspects of the controversy that surrounds this theme, in order not only to understand the reasons for the permanence of this criminalization to date in the Brazilian legal system, but also the possible consequences of a decriminalization of abortion in the Brazil. Initially, a study of the criminal type that criminalizes abortion is necessary, observing the historical 1940 was created. In addition to that, this paper explores the main sources of polarization in the discussion on abortion: the feminist and religious groups. We also examine the various theses on the initial moment of human life, a crucial point for the discussion of this theme. It has been concluded that decriminalization of abortion does not aim to inhibit abortion, but it ultimately damages women's fundamental rights, which is why it is believed that the regulated decriminalization of abortion, together with government policies, will protect the life of women who have to resort to clandestinity, thus, in line with the fundamental precepts of the Federal Constitution of 1988. |
