Negociação coletiva e crise
| Resumo: | O objetivo geral deste trabalho é verificar de que forma as alterações provocadas pela crise financeira de 2008, alteraram os princípios e funções da negociação coletiva. Para tanto, serão analisados no presente trabalho, o cenário histórico da negociação coletiva, seu conceito, princípios e funções, além de conhecer os meios que garantem a aplicação desse instituto, bem como alguns dos obstáculos à sua efetividade, com o fito de se constatar se houve ou não alterações na negociação coletiva por conta da crise. Não se limitando à análise normativa, além dos posicionamentos doutrinários, analisa-se neste trabalho uma queixa feita à OIT por uma organização sindical portuguesa, acerca de uma série de alterações legislativas feitas pelo Estado Português, na seara laboral, resultantes das medidas de austeridade imposta pela troika. Ao final, serão feitas algumas considerações a fim de se demonstrar o vínculo entre as temáticas discorridas durante a investigação. ABSTRACT The aim of this study is to verify how the changes brought about by the financial crisis of 2008 changed the principles and functions of collective bargaining. For this purpose, this study will analyze, the historical background of collective bargaining, its concept, principles and functions, in addition to knowing the means of ensuring the application of this institute, as well as some of the obstacles to its effectiveness, with the aim to find out if and how collective bargaining changes because of the crisis. In addition to normative analysis and doctrinal positions, this dissertation analyzes a complaint filed with the ILO by a portuguese trade union, on a number of legislative changes made by the Portuguese State involving labor issues, as a result of austerity measures imposed by the troika. Finally, some considerations will be made in order to demonstrate the link between the subjects studied during the research |
