Procedural guarantees and legal epistemology in the bargaining area

Resumo:The article aims to problematize the issue of evidence in the context of plea bargaining in its central aspects. With the suppression of the full criminal procedure and the determination of the facts without contradictory, would it be possible to build a rational decision, or one based on minimal evidentiary elements, according to some standard of sufficiency? The approach is justified due to the procedural specificity – pre-procedural for the most part –, with the lack of legitimacy of a full contradictory in the investigative phase and in a moment prior to the decision, in the deficit of transparency and communicability, as well as in the complexity of the test. It is intended to analyse the possibility of assessing the existence and degree of voluntariness in criminal agreements to support the decision, in an adequate and sufficient way, as voluntary.
