    Apresentação

    Publication
    by Pich, Roberto Hofmeister
    Other Authors: Santiago Culleton, Alfredo
    Origin: Mediaevalia

    Publication
    by Montes D’Oca, Fernando Rodrigues
    Origin: Mediaevalia
Abstract: The aim of this study is to present Francisco de Vitoria’s doctrine of the «law of nations» (ius gentium), and to explain why Vitoria does not accept a naturalist groundwork of it. According to Vitoria, neither the law of nations nor slavery can be grounded naturally, because they are not respective to what is absolutely fair, but only to what is relatively fair. Therefore, both the law of nations and slavery pertain to the positive law, i.e. the scope of law and right that treats of things that imply fairness only in a relative sense. Keywords: Francisco de Vitoria, law of nations, natural law, positive law, slavery.

    Publication
    by Schmitt, Flávio
    Origin: Mediaevalia
Abstract: Antonio Ruiz de Montoya is one of the most distinguished Jesuits in reductions that missioned to the Guarani of Paraguay during the 17th century, where he developed a fruitful apostolate. Soon after fi nishing his trip to Spain, where he had gone in search of real measures for protection of Indians threatened by the paulistas, he returned to Lima, where he died in 1652 with a reputation of holiness. Best known for his tireless missionary activity and for his works about the Guarani language, his inner life had been practically unknown until José Luis Rouillon Arróspide published and commented on it in the Sílex del Divino Amor, in 1991. This is this mature work. To prepare his disciple, Francisco del Castillo, in the path of contemplative prayer, Montoya collected and amplifi ed a number of key ideas and spiritual doctrines, from his own existential experience and personal prayer. Therefore, Ruiz de Montoya can be considered one of the writers who helped to promote the reception and development of Baroque Scholasticism in Hispanic America in the 17th century.
